Ambulance Chasing: Apple sued over iPod volume

This just in from the “Court TV Watchers Club” department…

Get your popcorn, Judge Judy fans; the fun’s about to begin! Again. The Associated Press reports that a Louisiana man is suing Apple because the iPod can cause hearing loss if listened to at high volumes over extended periods of time. Plaintiff John Kiel Patterson hopes the suit gains class-action status, potentially giving iPod owners the chance to be compensated for any possible hearing loss caused by their iPods. The claim states that the iPod is “inhenerntly defective in design and are not sufficiently adorned with adequate warnings regarding the likelihood of hearing loss.”

Apple specifically mentions the following on page 62 of the iPod 5G documentation:

Set your iPod volume to a safe level. If you experience ringing in
your ears, reduce the volume or discontinue use of your iPod.
Warning:  Permanent hearing loss may occur if earbuds or
headphones are used at high volume. You can adapt over time
to a higher volume of sound that may sound normal but can be
damaging to your hearing. If you experience ringing in your ears or
muffled speech, stop listening and have your hearing checked.
The louder the volume, the less time is required before your
hearing could be affected. Hearing experts suggest that to
protect your hearing:

  • Limit the amount of time you use earbuds or headphones at
    high volume.
  • Avoid turning up the volume to block out noisy surroundings.
  • Turn the volume down if you can’t hear people speaking…

Site News: January best month yet

January 2006 has been Deep Thought’s best month since its conception, boasting 1,755,736 hits, 74,582 unique visits and serving up a whopping 15,209,136 kilobytes (which comes out to 14.5 GB) of data.  The busiest days were the 10th, 11th and 19th, as our coverage of Macworld Expo and Nick’s review of iWeb brought massive piles of visitors to the site (as have the rest of the pieces of his review).

In comparison, the busiest month for Deep Thought before January was September 2005, which saw 1,090,738 hits and 40,667 unique visits.  September saw an average of 36,357 hits per day and 1,355 unique visits per day.  As of this writing, February is already at an average of 43,038 hits per day and 1,982 visits per day, meaning February could possible surpass January for overall traffic.  (Just for comparison, January had averages of 56,636 hits per day and 2,405 visits per day.)

This alone gives me a reason to buy a video iPod. Sweet!



Internet Explorer 7 beta available

Attention KMart sho--er, early adopters! Microsoft has released a public beta of Internet Explorer 7, a major update to the world’s most popular browser. IE 7 adds tabs, a streamlined UI, RSS reader capabilities, a web search box (yes, you can change which web search engine it uses), improved security, and more. Oh, and they updated the icon too! Microsoft’s site has more information, a tour, and download link.

Deep Thought will have an IE 7 Beta review in the near future.

Deep Thought’s take: Welcome to 2006, Internet Explorer. We’re glad you could make it. I only hope IE 7 has better standards compliance; it’ll make a web developer’s life much easier.



Mac Naming Convention

With the introduction of the new Intel Core based Macs, it appears that most of the Apple computers are getting a name change.

I posted this before elsewhere, but here are my predictions…

Pro Desktop : Mac Pro
Consumer Desktop : iMac (no change)
Budget Desktop : Mac mini (no change)
Pro Notebook : Mac Book Pro
Consumer Notebook : Mac Mobile or Mac Book

If the Consumer Notebook is named “Mac Book” then there might be a new Mac coming to be named “Mac Mobile” - maybe a portable version of the iMac? A tablet?
